Terms of Service

These terms govern your access to and use of the CruiseFeed cruise data feed, API and any files delivered to you (together, the “Service”). CruiseFeed is operated by CruiseFeed.io (“CruiseFeed”, “we”, “us”). By subscribing to a plan, using an API key, or receiving a data delivery, you (“you”, the “Customer”) agree to these terms. If you are agreeing on behalf of a company, you confirm you are authorised to bind it.

1.The Service

CruiseFeed provides a normalized dataset of cruise inventory — cruise lines, ships, sailing dates, itineraries, ports and lead-in prices — delivered as an API, or as CSV/JSON files by download or delivery to a storage location you nominate (such as an Amazon S3 bucket). The exact lines, coverage, refresh cadence and delivery method are those set out in your plan or agreed in writing with us.

2.Licence & permitted use

Subject to these terms and payment of the applicable fees, we grant you a non-exclusive, non-transferable, revocable licence to access and use the Service and the data it delivers internally, within your own product or business, for the duration of your subscription.

5.Cancellation

Subscriptions are month-to-month unless stated otherwise. You may cancel at any time, effective at the end of your current billing period; you keep access until then. We may suspend or terminate your access for breach of these terms, non-payment, or misuse of the Service. On termination, the licence in section 2 ends and you must stop using the data, save for any copies you are required to retain by law.

6.Data accuracy — provided “as is”

The data is aggregated and normalized from third-party cruise-line sources. Coverage, prices and availability change constantly and can contain errors, gaps or delays. The Service is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including any warranty of accuracy, completeness, merchantability or fitness for a particular purpose. The data is not a system of record and must not be relied upon as the sole basis for booking, payment, or pricing decisions. You are responsible for validating the data against the relevant cruise line before acting on it.

7.Limitation of liability

To the maximum extent permitted by law, CruiseFeed will not be liable for any indirect, incidental, special, consequential or exemplary damages, or for any lost profits, revenue, data or business, arising out of or relating to the Service, even if advised of the possibility. Our total aggregate liability for any claim arising out of or relating to the Service is limited to the fees you paid to us in the one (1) month immediately preceding the event giving rise to the claim. Nothing in these terms limits liability that cannot be limited by law.

8.Intellectual property

As between the parties, CruiseFeed retains all rights, title and interest in the Service, the compiled dataset, and its normalization, structure and identifiers. These terms grant you a licence to use the data, not ownership of it.

9.Changes to the Service or terms

We may update the Service and these terms from time to time. If we make a material change to these terms, we will update the “last updated” date above and, for active subscribers, give reasonable notice by email. Continuing to use the Service after a change takes effect means you accept the updated terms.

10.Governing law

These terms are governed by the laws of the jurisdiction in which CruiseFeed.io is established, and the courts of that jurisdiction have exclusive jurisdiction over any dispute, without regard to conflict-of-laws rules. Nothing in this section removes any mandatory consumer-protection rights you have under the laws of your own country of residence.
